Patiala: Former inspector jailed in kidnapping case

PATIALA: A two-year-old kidnapping case has landed a former inspector Joginder Singh in jail after a special court of the Central Bureau of Investigation (CBI) on Friday convicted the retired cop.

No charges could be proved by the prosecution agency against the three others involved in the case and the court acquitted former senior superintendent of police (SSP) Ajaib Singh, former assistant sub-inspector (ASI) Shyam Lal and former sub-inspector (SI) Hazoor Singh. There was another cop involved, superintendent of police (SP) Madanjit Singh but he left for heavenly abode last year.

One Dharam Singh had complaint to the police in 1994 and based on his statement, the case was registered. Dharam had alleged that his sons Balwinder Singh and Gurinder Singh had been kidnapped by cops from Partap Nagar, Patiala, and subsequently eliminated.

It was in 1997 that the case was handed over to the CBI by the Punjab and Haryana high court and several names surfaced who were cops and were involved in the case. The case was registered under sections 302, murder, and 102-B, criminal conspiracy, of the Indian Penal Code, IPC.

The CBI while investigating the case failed to find evidence of death of the missing persons but the cops were charged with abduction and wrongful confinement under sections 365, 368 and 343 of the IPC.

According to the information, on March 26 in 1993, Balwinder was abducted by Joginder, Hazoor, Shyam Lal and others from his house. The CBI stated that Balwinder was taken to then SP Madanjit Singh and then DSP Ajaib Singh, who kept him in illegal confinement.

Dharam Singh went to Joginder on April 2, the same year for the release of his son and for this the cop demanded Rs. 20,000 as bribe and asked Dharam to present his other son, Gurinder, before the police.

The deal was about Dharam giving Rs 20,000 to the cop and producing his son Gurinder but the accused instead of releasing his sons, held the second one also in captivity.

A false case was made by the police against Gurinder, which stated that Gurinder escaped from police custody.

It was mentioned by the CBI that the cops had tried to extort money from Dharam and held both youths in illegal confinement.

The judgment announced held Joginder guilty and acquitted all others.
