HC notice to Punjab on ‘illegal’ detention of legislator Bains

CHANDIGARH: The Punjab and Haryana high court on Thursday issued notices to Punjab and Ludhiana commissioner of police on the petition of Karamjeet Singh Bains, who has alleged that his MLA brother Balwinder Singh Bains had been “illegally” detained by the police.

Karamjeet, younger brother of Balwinder, submitted before the court that his MLA brother was detained on April 17 by the police and booked under Sections 107 (security for keeping the peace in other cases) and 151 (arrest to prevent the commission of cognizable offences) of Criminal Procedure Code, and put in Ferozepur jail.

“Even those with a criminal past, booked under these sections are produced before a court within 24 hours. But the police are not doing so in the case of a public representative,” petitioner’s lawyer Deepender Singh said.

Balwinder was arrested on April 17 for reportedly launching ‘satyagraha’ (agitation) against the sand mafia in Ludhiana.

The petitioner has contended that Balwinder was not being produced before the court of the magistrate after his arrest.

The petitioner has further contended that when approached by them, a magistrate had refused to accept the bail bonds and fixed the next date of hearing for April 30.
